Brown Legacy Holdings LLC (“we,” “our,” “us”) is a family-owned business based in Bakersville, North Carolina, offering cleaning, handyman, lawn, and property maintenance services under multiple trade names, including Bakersville Fix N’ Shine.
Our website and software tools (including our scheduling and payment system) are designed to make your experience simple, transparent, and efficient.
2. Acceptance of Terms
By visiting our website, submitting an intake form, booking services, or communicating with us digitally, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our site or services.
We may update these Terms at any time. The “Last Updated” date will reflect the most recent revision.
3. Use of Our Website and Software
You may use our website and scheduling software solely for lawful purposes and to engage our services. You agree not to:
Attempt to disrupt or misuse our systems or data;
Provide false, misleading, or incomplete information when scheduling or communicating;
Copy, reproduce, or redistribute website content without written permission.
We reserve the right to terminate or restrict access to our systems for misuse or fraudulent activity.
4. Quotes, Estimates, and Service Agreements
All pricing provided through our online quotes, emails, or scheduling software are estimates based on the information you provide.
Prices may be adjusted at the time of service if:
The property condition differs from what was described,
Additional labor, materials, or time are required, or
The scope of work changes after booking.
We will always communicate any adjustments transparently before proceeding.
5. Payment Terms
Payment is due upon completion of services unless otherwise stated in writing. We accept major debit/credit cards and electronic payments through our secure client platform.
Late or unpaid balances may incur reasonable administrative fees. If payment is not received within the agreed time frame, Brown Legacy Holdings LLC reserves the right to pause future services or pursue collection in accordance with North Carolina law.
6. Cancellations & Rescheduling
We understand life happens and you may reschedule or cancel your appointment with at least 24 hours’ notice.
Cancellations or reschedules within 24 hours of your appointment time may result in a $50 late-cancellation fee to cover travel and scheduling costs, at owner’s discretion.
In rare circumstances (e.g., unsafe conditions, weather, or emergencies), we may reschedule at no penalty to you.
7. Access & Property Conditions
To perform services, our team must have safe, reasonable access to your property.
Please ensure:
Power and water are available (unless otherwise arranged),
Pets and personal belongings are secured,
Work areas are free of hazards or debris that could prevent service.
If conditions make the job unsafe or impractical, our team may decline or postpone the service and apply a trip charge.
8. Satisfaction Guarantee
We stand by the quality of our work. If you’re not fully satisfied, please contact us within 24 hours of service completion, and we’ll make every reasonable effort to correct the issue.
Our goal is simple: we leave your property better than we found it.
9. Limitation of Liability
While we take great care with every service, Brown Legacy Holdings LLC is not liable for:
Pre-existing damage or wear-and-tear to surfaces or materials,
Accidents or issues caused by undisclosed hazards or property conditions,
Indirect, incidental, or consequential damages resulting from use of our website or services.
Our total liability shall not exceed the amount paid for the specific service in question.
10. Insurance & Bonding
We are fully insured and surety bonded. Proof of coverage can be provided upon request.
This ensures our clients and team members are protected in the event of unforeseen incidents or damage.
11. Privacy & Data Security
Your personal information is protected under our Privacy Policy. We use secure, encrypted software (Jobber) for scheduling, communication, and payments. We never sell or misuse your personal data.
12. Third-Party Links & Software
Our website may include links to third-party websites or software platforms (such as our booking or payment portals).
We are not responsible for the content, accuracy, or practices of any third-party service.
When using those systems, you are subject to their respective Terms of Use and Privacy Policies.
13. Intellectual Property
All website content including text, photos, graphics, logos, and design elements are the property of Brown Legacy Holdings LLC and protected by copyright law. Unauthorized use, reproduction, or distribution is prohibited.
14. Governing Law
These Terms are governed by and interpreted under the laws of the State of North Carolina, without regard to conflict of law principles.
